Building Laborers Wage Package

Bulletin 47-16 contains the wage and fringe benefits packages for the New Jersey Building Construction Laborers' District Council Locals 3 & 77 as well as the rates for the Interior Demolition & House Wrecking Laborers, all effective May 1, 2016.  Access the bulletin in the members-only section at accnj.org.

Independence Day Holiday

Final Federal Overtime Rule Published

As we posted in Hot Topics, in mid-May the US Department of Labor published the final rule that doubles the salary minimum for an employee to qualify for overtime. Previous to the new rule, an employee had to earn $455 or less per week, or up to $23,600 annually, to qualify for overtime after 40 hours of work. Beginning December 1, an employee who makes $913 per week or less, or up to $47,476 annually, will qualify for overtime (defined as "time-and-a-half") after 40 hours, unless the employee's position is classified as executive, administrative or professional. Employees are also exempt from the overtime rule if they have a predetermined or fixed salary that isn't docked because of quality or quantity of work performed. But many employees who make the minimum or less and work long hours could qualify. AGC of America has lobbied against the rule, citing unfortunate and unintended consequences for construction company employees. 

Legislature Passes, Governor Signs AC Rescue Package

In short order on May 26 and 27, after months of turmoil, the New Jersey Legislature passed and Gov. Christie signed two bills that give some breathing room to Atlantic City in lieu of a state takeover. The first bill gives the city 150 days to come up with a five-year fiscal plan, including a balanced budget next year. The second allows AC casinos to make fixed payments in lieu of taxes, PILOTS, for 10 years, while barring them from appealing property taxes. While it drafts a fiscal plan, the state will give Atlantic City a secured bridge loan for six months.

Advance Release of New Jersey Construction Articles

The Spring 2016 issue of ACCNJ's magazine, New Jersey Construction, is due to be published in June, but we emailed members two articles in advance of the publish date because the subjects are of extreme importance. The first article, emailed May 3, is an in-depth review of the Kevin Duncan study on prevailing wage, of which we had a preview from Kevin Duncan himself at the March Membership Meeting. The second article, contributed by ACCNJ member Susanin, Widman & Brennan PC and emailed May 12, answers one of the most critical questions following the passage of the Multiemployer Pension Reform Act of 2014, "Are Contractors Liable If a Multiemployer Plan Fails?" ACCNJ Membership Meeting - June 7 - Last Call!
